Please read the following so you understand the terms and conditions that apply to a booking you make on our website.
1.1 This Hinterland Accommodation Booking Service is operated by bookhinterland.com.au ("us", "we" and "our").
1.2 bookhinterland.com.au is a trading name of WorldWide WiZZard Pty Ltd.
1.3 Customer ("you") means a person who books accommodation through the Site.
1.4 Accommodation Property includes rooms in bed and breakfasts, cottages, guesthouses, apartments, hotels, motels or other accommodation.
1.5 Site means this website, designed constructed and maintained by us, that offers the facility to book accommodation to the public at large.
1.6 Accommodation Provider means the owner or authorised agent of the owner of an Accommodation Property who has agreed with us to list the Accommodation Property on the Site.
2.1 The Booking Service acts as a booking agent for the Accommodation Provider, making booking contracts between you and the Accommodation Provider of the Accommodation Property that you have selected.
2.2 Bookings made through the Booking Service by you are made on behalf of the Accommodation Provider. You agree that the Accommodation Provider has sole responsibility for delivery of the services being booked by you and that we are not liable for default by the Accommodation Provider.
3. PAYMENT FOR BOOKINGS
3.1 You agree to pay us by debit to your credit card account, or nominated PayPal account, the specified booking fee and the cost of the accommodation.
3.2 All fees are tax inclusive where applicable.
3.3 We will issue you with a valid confirmation in respect of each booking.
3.4 We receive payment from the Accommodation Provider for providing this booking service.
3.5 You acknowledge that a third party (Card Authoriser or PayPal) will process the credit card transactions required in respect of a booking. You agree that we are not liable for any default by the Card Authoriser.
4.1 We reserve the right to refuse any booking and for an Accommodation Provider to cancel any booking already made if the Accommodation Property becomes unavailable for reasons beyond the control of the Accommodation Provider.
4.2 Individual Accommodation Providers may apply their own Cancellation Policy and Cancellation penalties depend upon the policy of the Accommodation Provider as provided on the Site.
4.3 Where the Accommodation Provider does not specify a Cancellation Policy then the following Cancellation Policy will apply:
|4.3.1||Cancellations notified more than 28 days prior to the booking will incur a $20 (incl. GST) cancellation fee.|
|4.3.2||Cancellations notified 28 days or less and more than 14 days prior to the booking arrival date will forfeit the full deposit or 50% of the total booking whichever is less.|
|4.3.3||Cancellation 14 days or less prior to the booking will forfeit all monies paid.|
|4.3.4||Any other changes to booking dates will incur a $20 amendment fee. No changes may be made less than 14 days prior to the booking arrival date.|
|4.3.5||A $20 administration fee applies to all booking cancellations and amendments.|
5.1 You may be required to present photo ID on arrival at the Accommodation Provider premises.
5.2 A credit card pre-authorisation or cash deposit may be required to cover incidental charges.
6. DISPUTES AND COMPLAINTS
6.1 Information on this website is based on details supplied by each Accommodation Provider. Whilst we endeavour to ensure all information presented is accurate, we provide no guarantee that the information is free from errors or faults, and accept no liability for any errors or omissions as all information in relation to accommodation and premises is provided by the Accommodation Provider.
6.2 We provide no warranty or representation about the suitability of any product or service being advertised on this Site.
6.3 Any dispute between the Accommodation Provider and you must be settled directly with the Accommodation Provider, for whose actions we cannot accept any responsibility.
6.4 Any complaints should be made in writing to us so we can forward the complaint to the Accommodation Provider, and to enable the Accommodation Provider the opportunity to remedy the complaint with you.
6.5 No responsibility will be accepted for complaints received more than 14 days after the event.
7.1 You must keep the Accommodation Property in good order and you will be liable to the Accommodation Provider for any damages to the Accommodation Property.
7.2. We, our agents and staff shall not be liable for any damages, injury, loss or delay howsoever caused whilst at the Accommodation Property or any related activity.
7.3. We accept no responsibility for any misrepresentation, unforeseen omissions or additional costs incurred in relation to information provided by the Accommodation Provider.
7.4 We are not responsible for the actions, defaults, or negligence of any Accommodation Provider.
7.5 Our liability for loss or damage of luggage, compensation for distress, disappointment and loss of enjoyment is limited in total to the price of the accommodation booked.
8. THIRD PARTY COMMISSIONS
8.1 We do not pay commissions to Travel Agents using the Site. Travel Agents should contact us to negotiate rates and commissions.
9. PERSONAL INFORMATION AND PRIVACY
9.1 We need to collect personal information about you to process your booking for accommodation. If we cannot collect this information, we will be unable to make a booking in your name. We respect your privacy and will only use or disclose your information in accordance with the Privacy Act 1988.
9.2 The Information provided will be used by the Bed & Breakfast Booking Service South Australia to process the booking in accordance with your instructions. The information will only be disclosed to the Accommodation Provider for the Accommodation Property that we book for you. The Bed & Breakfast Booking Service South Australia will not disclose the Information to any other person or organisation.
10.1 Where applicable all rates include GST.
11. APPLICABLE LAW
11.1 This agreement is governed by the laws of Australia and Queensland as applicable, and the parties agree to the appropriate jurisdiction for any legal proceedings arising out of this agreement.
11.2 We reserve the right to change information published on our websites at any time.
